Terms of website use

These Terms of Use, together with the other policies and documents referred to in them, explain the terms on which you may use brighton.co.uk a site operated by BR19HTON Ltd, whether as a guest or a registered user. Use of our site includes accessing, browsing, or registering to use our site.

These Terms also apply when you submit or manage an Event Listing or Organiser Profile, submit or purchase a Job Listing, or otherwise use our Jobs and Events services.

Where you make a purchase through Brighton.co.uk, you agree to the terms applying to that purchase when you complete the relevant checkout process.

Please read these terms of use carefully before you start to use our site, as these will apply to your use of our site.

By using our site, you confirm that you accept these terms of use and that you agree to comply with them.

If you do not agree to these Terms, you must not use the Website, submit content, create or manage a Listing, submit an Event Listing or Organiser Profile, or purchase a Job Listing.

These terms of use refer to the following additional terms, which also apply to your use of our site:

Our Privacy Policy, which explains how we collect, use, store and protect your personal data, the lawful bases on which we process it, and the rights available to you.

Our Acceptable Use Policy, which sets out the permitted uses and prohibited uses of our site. When using our site, you must comply with this Acceptable Use Policy.

Our Brighton Spotlight Terms & Conditions, which apply to all paid and free Spotlight Listings, subscriptions, billing, renewals, cancellations and related services.

Relationship with Other Policies

Our Privacy Policy and Acceptable Use Policy also apply to your use of Brighton.co.uk.

Where you create, claim or manage a Spotlight Listing, or purchase or manage a Brighton Spotlight subscription, the Brighton Spotlight Terms & Conditions will also apply.

Where there is any conflict between these Website Terms & Conditions and the Brighton Spotlight Terms & Conditions in relation to a Spotlight Listing, Spotlight Subscription or associated billing, the Brighton Spotlight Terms & Conditions will take precedence.

Job Listings, Event Listings and Organiser Profiles are separate Brighton.co.uk services governed by these Website Terms & Conditions and our Acceptable Use Policy. Linking a Job Listing or Event Listing to a Spotlight Listing does not give the submitter ownership or management rights over that Spotlight Listing and does not, by itself, make the submitter subject to the Brighton Spotlight Terms & Conditions as a Listing Owner.

Changes to our site

We may update our site from time to time, and may change the content at any time. However, please note that any of the content on our site may be out of date at any given time, and we are under no obligation to update it.

We do not guarantee that our site, or any content on it, will be free from errors or omissions.

Accessing our site

Access to the public areas of our Website is generally available free of charge. Certain products, subscriptions and services are subject to Fees, which will be displayed before purchase.

We do not guarantee that our site, or any content on it, will always be available or be uninterrupted. Access to our site is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of our site without notice. We will not be liable to you if for any reason our site is unavailable at any time or for any period.

You are responsible for making all arrangements necessary for you to have access to our site.

You are also responsible for ensuring that all persons who access our site through your internet connection are aware of these terms of use and other applicable terms and conditions, and that they comply with them.

Our site is directed to people residing in the United Kingdom. We do not represent that content available on or through our site is appropriate or available in other locations. We may limit the availability of our site or any service or product described on our site to any person or geographic area at any time. If you choose to access our site from outside the United Kingdom, you do so at your own risk.

Keeping your account safe

If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party.

We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use.

If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at privacy@brighton.co.uk.

Business Accounts and Listings

Users who register an account may create, claim or manage Spotlight Listings on Brighton.co.uk. The creation and management of Listings, including any Brighton Spotlight subscription, are subject to the Brighton Spotlight Terms & Conditions.

Brighton.co.uk may also offer separate services through which users can submit Event Listings, Organiser Profiles and Job Listings. These are separate from the Spotlight Listing itself, even where they are associated with or displayed alongside a Spotlight Listing.

Job Listings, Event Listings and Organiser Profiles

For the purposes of these Terms:

Spotlight Listing: A business or venue profile published within Brighton Spotlight, whether on a free or paid plan.

Job Listing means an advertisement for one vacancy submitted for publication through the Brighton.co.uk Jobs service.

Job Listing Fee means the one-off charge payable for a Job Listing, as displayed at checkout.

Job Listing Period means the period during which an approved Job Listing is published on Brighton.co.uk.

Event Listing means information about an event submitted for publication in the Brighton.co.uk events calendar.

Organiser Profile means a profile identifying the person, business, group or organisation responsible for organising or promoting an Event.

Venue Spotlight: The published Spotlight Listing selected to identify the venue or location associated with an Event Listing.

General submission requirements

When you submit a Job Listing, Event Listing or Organiser Profile, you confirm that:

  • the information you provide is accurate, current, lawful and not misleading;

  • you are authorised to submit the information or otherwise have a lawful and reasonable basis for doing so, and you are entitled to associate it with any selected Spotlight Listing;

  • you own, or have obtained all necessary rights, licences and permissions to use and publish the content you submit;

  • where the submitted content includes identifiable individuals, you have obtained any permissions or consents required for its publication and promotional use;

  • the submission complies with these Terms and our Acceptable Use Policy; and

  • you will promptly update or notify us about any material change.

We may contact the employer, recruitment provider, Organiser, venue or manager of an associated Spotlight Listing to verify the accuracy of a submission or your authority to make it.

All Job Listings, Event Listings and Organiser Profiles are subject to review. We may edit formatting, correct categories, merge duplicate records, request changes, reject, suspend, expire or remove a submission where we reasonably believe that it is inaccurate, unlawful, misleading, unauthorised, out of date or otherwise unsuitable for Brighton.co.uk.

Approval or publication of a Job Listing, Event Listing or Organiser Profile does not constitute verification, recommendation or endorsement by Brighton.co.uk.

If a linked Spotlight Listing is removed, suspended or no longer available, we may ask you to select another appropriate Spotlight Listing or may suspend or remove the associated Job Listing or Event Listing.

Job Listings

Eligibility and authority

You must have a registered Brighton.co.uk account to submit or purchase a Job Listing.

The Job Listing service is intended only for employers, recruitment providers and other authorised representatives acting in the course of a trade, business, craft or profession. By purchasing a Job Listing, you confirm that you are acting as a business customer and not as a consumer.

Each Job Listing must be associated with a relevant published Spotlight Listing.

You do not need to own or manage the selected Spotlight Listing. However, you confirm that you are authorised by the relevant employer, recruitment provider or other responsible organisation to:

  • advertise the vacancy;

  • provide the information contained in the Job Listing; and

  • associate the Job Listing with the selected Spotlight Listing.

Selecting a Spotlight Listing:

  • does not give you ownership or management rights over it;

  • does not mean that its owner submitted or approved the Job Listing; and

  • must not be used to falsely suggest that you represent a business.

We may request evidence of your authority and may contact the business or manager associated with the selected Spotlight Listing. We may withhold, reject, suspend or remove a Job Listing if satisfactory evidence of authority is not provided.

One vacancy per Job Listing

Each Job Listing Fee covers one vacancy only.

You may correct or update information relating to the same vacancy, but you must not use an existing Job Listing to advertise a materially different role or vacancy.

We may treat a change to the employer, job title, principal duties, location or other material details as a new vacancy requiring a separate Job Listing and Job Listing Fee.

Fees and VAT

The applicable Job Listing Fee will be shown before you complete payment.

Unless expressly stated otherwise, prices are exclusive of VAT. VAT will be added at the applicable rate, and the total amount payable will be displayed before payment is completed.

The Job Listing Fee is a one-off payment. Job Listings do not renew automatically.

Purchasing a Job Listing does not change, upgrade or extend the Discover Plan, Grow Plan or Elevate Plan associated with the selected Spotlight Listing.

Submission, payment and approval

Payment and submission of a Job Listing do not guarantee publication.

Your submission constitutes a request to purchase publication of a Job Listing subject to our review and approval. We accept that request when we approve the Job Listing for publication.

We aim to review Job Listings within 24 hours of submission, but this is a target and is not guaranteed. We may approve the Job Listing, request amendments or reject it.

Job Listing Period

Unless otherwise stated at checkout, an approved Job Listing will be published for 30 consecutive days.

The Job Listing Period begins when we approve the Job Listing for publication. Approval will normally cause the Job Listing to be published. If a technical delay means that the Job Listing is not publicly accessible at that time, the Job Listing Period will begin when it first becomes publicly accessible on Brighton.co.uk.

At the end of the Job Listing Period, the Job Listing will expire. It may be removed from current Job search results, removed from public view or displayed as an expired Job Listing.

A new Job Listing purchase will be required if you wish to advertise the vacancy for a further period.

Rejected Job Listings

If we reject a Job Listing before publication, we will provide a full refund of the amount paid, including VAT, to the original payment method.

The time taken for a refund to appear in your account may depend on your bank or payment provider.

Refunds after publication

Once a Job Listing has been approved and published, the Job Listing Fee is generally non-refundable, including where:

  • the vacancy is filled before the end of the Job Listing Period;

  • the employer closes or withdraws the vacancy;

  • you ask us to remove the Job Listing;

  • the external application link becomes unavailable;

  • the Job Listing receives no applications or enquiries; or

  • you no longer wish to advertise the vacancy.

No refund will normally be provided where we suspend or remove a Job Listing because it breaches these Terms or our Acceptable Use Policy.

This does not affect any refund required by law or any refund that we agree to provide in writing.

If we permanently remove an approved Job Listing before the end of the Job Listing Period for reasons not caused by your breach of these Terms, we may provide an appropriate remedy, such as republishing the Job Listing, extending the Job Listing Period or refunding an appropriate proportion of the Job Listing Fee.

Editing a Job Listing

You may edit a Job Listing to correct or update information about the same vacancy.

Any amendment may be subject to further review and approval. We may temporarily withhold or suspend the amended Job Listing while the changes are reviewed.

Approval of an amendment does not restart or extend the original Job Listing Period.

A Job Listing must not be edited to advertise a different vacancy. A materially different vacancy requires a new submission and a new Job Listing Fee.

Job Listing standards

You are responsible for ensuring that each Job Listing:

  • relates to a genuine and current vacancy;

  • correctly identifies the employer or recruitment provider;

  • is accurate, complete, lawful and not misleading;

  • accurately describes the role, location, working arrangements, hours, remuneration or salary where stated, closing date and application process;

  • does not contain unlawful or discriminatory wording or requirements;

  • complies with applicable employment, equality, advertising and recruitment laws;

  • does not misrepresent employment as self-employment, voluntary work or another type of arrangement;

  • contains a valid and appropriate external application link; and

  • is promptly updated or closed if the vacancy is filled, withdrawn or no longer available.

You must not use a Job Listing to obtain money, financial information or personal information dishonestly or under false pretences.

Our role in relation to Jobs

Brighton.co.uk provides Job Listings as an advertising and information service.

Unless expressly agreed otherwise, we do not:

  • employ candidates;

  • act on behalf of an applicant;

  • screen, assess or shortlist applicants;

  • make recruitment or hiring decisions;

  • verify an applicant’s identity, qualifications or suitability;

  • guarantee that a vacancy remains available;

  • guarantee that a Job Listing will receive applications or enquiries; or

  • guarantee that an application will result in employment.

Employers and recruitment providers remain solely responsible for their recruitment process, communications with applicants and hiring decisions.

External job applications

Applications for jobs advertised on Brighton.co.uk are completed through an external website operated by the relevant employer, recruitment provider or application platform.

Brighton.co.uk does not receive or process CVs, covering letters, application answers or other information submitted through that external application process.

When an applicant follows an external application link, they leave Brighton.co.uk. The external website’s own terms, privacy notice and security arrangements will apply.

We are not responsible for the availability, security, content, operation or data-processing practices of an external application website.

Event Listings and Organiser Profiles

Submitting an Event

Every Event Listing must be associated with:

  • an Organiser Profile; and

  • a relevant published Venue Spotlight.

Where the relevant Organiser Profile does not already exist, you may submit a new Organiser Profile for our review and approval.

Approval of an Organiser Profile does not mean that we have verified or endorsed the Organiser.

You confirm that you are authorised by the Organiser to submit the Event Listing or that you otherwise have a lawful and reasonable basis for submitting accurate publicly available information about the Event.

Venue Spotlight

You do not need to own or manage the Venue Spotlight selected for an Event Listing.

Selecting a Venue Spotlight:

  • identifies the stated location of the Event only;

  • does not give you ownership or management rights over the Venue Spotlight;

  • does not mean that the venue owner submitted, approved or endorsed the Event;

  • does not make the venue owner responsible for information submitted by you; and

  • must not be used to falsely suggest a relationship with the venue.

You must only associate an Event with a venue where you reasonably believe that the Event is scheduled or authorised to take place.

We may correct, change or remove a venue association where it is inaccurate, disputed, no longer current or cannot be satisfactorily verified.

Event information and responsibilities

The person submitting the Event Listing and the relevant Organiser are responsible for ensuring that the Event information is accurate, complete, current, lawful and not misleading.

This includes information relating to:

  • Event dates and times;

  • the venue and location;

  • performers, speakers, activities or programme;

  • ticket prices and availability;

  • booking arrangements;

  • age restrictions;

  • accessibility information;

  • admission conditions;

  • cancellations, postponements or changes; and

  • any material terms affecting attendees.

The Organiser remains responsible for:

  • obtaining all licences, permissions, consents and insurance required for the Event;

  • complying with applicable laws and venue requirements;

  • Event management, public safety and safeguarding;

  • ticket sales, admission and attendee communications;

  • responding to complaints; and

  • refunds or other obligations arising from cancellation, postponement or changes to the Event.

You must promptly update the Event Listing or notify us if the Event is cancelled, postponed, moved, sold out or materially changed.

Charges for Event Listings

Standard Event Listing submissions are currently free.

We may introduce charges, paid promotional options or additional Event features in the future. No charge will be made unless the applicable price and terms are shown to you and accepted before payment.

Our role in relation to Events

Brighton.co.uk provides an events calendar and information service.

Merely displaying an Event Listing does not make Brighton.co.uk the Event organiser, promoter, venue, ticket seller or booking agent.

We do not guarantee that:

  • an Event will take place;

  • an Event will take place at the stated date, time or venue;

  • performers or advertised activities will appear;

  • tickets will remain available;

  • information supplied by an Organiser will remain current; or

  • an Event will be suitable for a particular attendee.

Users should confirm important Event details directly with the Organiser, venue or ticket provider before travelling, booking or attending.

External ticketing and booking services

Ticket purchases and Event bookings may be completed through external websites operated by Organisers, venues or ticket providers.

When you follow an external ticketing or booking link, the external provider’s terms, privacy notice, refund policy and security arrangements will apply.

Brighton.co.uk is not responsible for external ticketing services, attendee information submitted to them, their charges or their handling of cancellations and refunds.

Moderation, expiry and removal

We may approve, reject, edit, merge, suspend, expire or remove an Event Listing or Organiser Profile where we reasonably believe that it:

  • is inaccurate, misleading, duplicated or out of date;

  • has been submitted without appropriate authority;

  • is linked to an incorrect Organiser or venue;

  • breaches these Terms or our Acceptable Use Policy;

  • infringes another person’s rights;

  • may expose Brighton.co.uk to legal or regulatory liability; or

  • may damage the integrity, security or reputation of Brighton.co.uk.

Event Listings may be automatically archived, marked as past or removed from current search results after the relevant Event date.

Intellectual property rights

We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it.

Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

You may print off one copy, and may download extracts, of any page(s) from our site for your personal use and you may draw the attention of others within your organisation to content posted on our site.

You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

Our status (and that of any identified contributors) as the authors of content on our site must always be acknowledged.

You must not use any part of the content on our site for commercial purposes without obtaining a licence to do so from us or our licensors.

If you print off, copy or download any part of our site in breach of these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

No reliance on information

The content on our site is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on our site.

Although we make reasonable efforts to update the information on our site, we make no representations, warranties or guarantees, whether express or implied, that the content on our site is accurate, complete or up-to-date.

Accuracy of Information

We aim to ensure that information published on Brighton.co.uk is accurate and up to date. However, information such as opening hours, prices, availability, contact details, Event dates, venues, ticket availability, Job vacancies, remuneration, closing dates and application arrangements may change without notice.

While we take reasonable care in preparing and publishing content, we cannot guarantee that all information on the Website will always be complete, accurate or current.

Users should verify important information directly with the relevant business, employer, recruitment provider, Organiser, venue or ticket provider before travelling, booking, making a purchase, attending an Event or submitting a job application.

Limitation of our liability

Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our site or any content on it, whether express or implied.

We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

  • use of, or inability to use, our site;
  • or use of or reliance on any content displayed on our site.

If you are a business user, please note that in particular, we will not be liable for:

  • loss of profits, sales, business, or revenue;
  • business interruption; loss of anticipated savings;

Without limiting the other exclusions and limitations in these Terms, and to the extent permitted by law, Brighton.co.uk is not a party to any employment, recruitment, ticketing, booking, attendance or venue arrangement arising from a Job Listing or Event Listing.

We are not responsible for:

  • the acts or omissions of employers, recruitment providers, applicants, Organisers, venues, ticket providers or other third parties;
  • the outcome of any job application or recruitment process;
  • a vacancy being changed, withdrawn or filled;
  • an Event being changed, postponed or cancelled;
  • a refusal of admission to an Event;
  • the availability or validity of tickets;
  • information submitted to an external application, booking or ticketing website; or
  • losses arising from reliance on information supplied by a third party,

except where liability cannot lawfully be excluded or limited.

Uploading content to our site

Whenever you make use of a feature that allows you to upload content to our site, or to make contact with other users of our site, you must comply with the content standards set out in our Acceptable Use Policy.

You warrant that any such contribution does comply with those standards, and you will be liable to us and indemnify us for any breach of that warranty. If you are a consumer user, this means you will be responsible for any loss or damage we suffer as a result of your breach of warranty.

Any content you upload to our site will be considered non-confidential and non-proprietary. You retain all of your ownership rights in your content, but you are required to grant us and other users of the Site a limited licence to use, store and copy that content and to distribute and make it available to third parties. Where you upload content as part of a Brighton Spotlight Listing, the Brighton Spotlight Terms & Conditions will also apply.

The requirements in this section apply to content submitted as part of a Job Listing, Event Listing or Organiser Profile, including text, logos, photographs, images, videos, graphics, documents and links.

You confirm that you own or have obtained all rights, licences, permissions and consents required to submit and publish that content. Where content includes identifiable individuals, you confirm that you have obtained any permissions or consents required for its publication and promotional use.

Rights you licence

When you upload or post content to our site, you grant the following license:

  • A worldwide, non-exclusive, royalty-free licence to permit our service providers and distribution partners to use the content only as reasonably necessary to operate, display, distribute and promote Brighton.co.uk and its services.

We will use submitted content only for the purposes described in these Terms, providing and promoting the relevant Brighton.co.uk services, complying with the law and exercising or defending legal rights.

Where you upload Listing Content as part of a Brighton Spotlight Listing, the licence granted under the Brighton Spotlight Terms & Conditions will also apply.

Without limiting the licences granted above, where you submit content as part of a Job Listing, Event Listing or Organiser Profile, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, store, publish, display, format, resize, crop, compress, reformat and distribute that content for the purposes of operating, displaying and promoting Brighton.co.uk and the relevant Job or Event service, including through the Website, search results, newsletters, social media channels and other promotional materials.

Viruses

We do not guarantee that our site will be secure or free from bugs or viruses.

You are responsible for configuring your information technology, computer programmes and platform in order to access our site. You should use your own virus protection software.

You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack.

By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

Linking to our site
